UIGEA – Barney Frank’s Online Gambling Bill and Unanswered Questions

UIGEA or Unlawful Internet Gambling Enforcement bill (UIGEA) is a law which helps the government to nail any financial institution who is aiding fund transfer from “unlawful online gambling”. But surprisingly there is no clear cut definition of “unlawful online gambling” mentioned in Federal laws. Naturally, the question come up how can a law nail a financial institution dealing with fund transfer of an online casino when the determination of the nature of gambling, i.e. legal or illegal, is not defined by federal law? Thus, this erroneous and hastily implemented UIGEA becomes unintelligible.

Barney Frank, the democrat representative to US Congress has raised several issues relating to UIGEA and finally has drafted a proposal called “Internet Gambling Regulation Consumer Protection and Enforcement bill”. But this bill is also not full-proof and many casinos are also objecting to this.

Problems Related to Barney Frank’s Proposed Bill

  • One of the basic problems related to this new proposed bill is that it gives all powers to the federal state itself and takes away all online gambling related laws from the state. For instance, powers of giving license to online casinos are given solely to Treasury Department.  States along with the tribes are enrolled in the online casino licensing program. Thus, the taxes that would be collected from online casinos will go to the Federal government and not to the state government.
  • Tribal casinos operate in many states and thus they both have legal conflicts between them. According to Frank’s proposed bill, the tribal online casinos would have their own set of laws and would not be guided by the state laws and jurisdictions. Now, the confusion crops up: What would happen if an American logs into a tribal casino website from his PC from USA?

Critical Questions on Online Gambling Bill of Frank

Some critical questions have been raised by experts on Frank’s online gambling bill and they are:

  1. Would it be able to protect the interests of the service providers of financial transactions related to online casino winnings?
  2. Will this new bill eat into the tribal casino profits?
  3. Is it good to bar the states from collecting the online casino taxes?
